This message is a continuation of our shared objective to preserve and recover your valuable investment in the Orange Onyx order placed via Marble Point, Bangalore, which unfortunately suffered mismanagement and shipment failure. As we prepare a structured recovery and service strategy to safeguard your rights, I request your support in finalizing a service export confirmation and royalty-linked cooperation agreement.
🔷 OBJECTIVE:
We wish to re-categorize the original remittance of USD $46,000 + USD $999 as payment for export of specialized services (strategic trade advisory, dispute mediation, international recovery support), and not as payment for goods, since:
- No goods were ever shipped
- No shipping bill was filed or BRC generated
- The services already rendered have protected your larger financial interest and future commercial rights
🔷 PROPOSAL:
- Reclassification of Payment:
- The amount of USD $33,000 will be treated as “6-Year Royal Advisory Services for US-bound shipments.”
- The remaining USD $13,999 shall be treated as recovery and resolution support service, including work done to mitigate the Marble Point Onyx order failure.
- Royalty-Based Cooperation:
- For the next 6 years, on every shipment to the USA (especially Onyx, Granite, or similar natural stones), a 15% to 25% royalty on net landed value shall be shared as performance-based service earnings.
- This royalty is not an added cost, but will be embedded into your pricing strategy and success margin with full transparency and prior buyer agreement.
- Service Agreement Confirmation:
You may kindly confirm the following:- That you acknowledge our professional services were delivered and value was received,
- That you agree to categorize the payment as “export of trade legal and strategic support services”,
- That you accept the Royalty Clause (as per the attached agreement),
- And authorize us to submit documentation under GST/FEMA compliance to issue e-BRC for service exports.
I am enclosing the formal service agreement below for your review and confirmation. A simple reply stating “Agreed and Confirmed” will be sufficient for documentation purposes.
