This was done without issuing prior notice, obtaining borrower consent, or complying with mandatory <strong>RBI regulatory procedures<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In a parallel and deeply suspicious move, <strong>ICICI Bank<\/strong>, while sanctioning a \u20b92.5 crore MSME business loan, released <strong>less than \u20b938 Lakhs<\/strong> to the borrower. However, <strong>\u20b975 Lakhs was directly diverted to UUCB<\/strong>\u2014<strong>without any loan agreement clause permitting such transaction<\/strong>, and without approval of the borrower. This amount was falsely shown as a &#8220;settlement&#8221; of the UUCB loan, even though ICICI had no contractual basis to make such payment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This fraudulent diversion served two illegal objectives:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>To hijack the collateral<\/strong> directly from UUCB and transfer it to ICICI Bank\u2019s control\u2014without the borrower\u2019s signature, consent, or knowledge.<\/li>\n\n\n\n<li><strong>To block any future financing options<\/strong>, by freezing the most valuable asset (the borrower\u2019s house) under a new charge without transparency or fair procedure.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">Further, to cover the shortage required to release the property from UUCB records, the <strong>same agent (working with both banks and the borrower\u2019s CA)<\/strong> deposited a small top-up amount towards closure charges\u2014again, without written approval of the borrower. Under <strong>duress and deception<\/strong>, blank signed and stamped documents were collected from the legitimate MSME borrower and later <strong>forged<\/strong> into a <strong>Home Loan agreement<\/strong>, overriding the original MSME business loan sanctioned for export operations. The <strong>mortgage was never registered<\/strong>, yet ICICI forcibly marked a charge over the borrower\u2019s prime residential property without following any legal due process.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In a calculated act of betrayal, <strong>malicious co-borrowers<\/strong>\u2014including <strong>Praveen Choudhary and Rahul Chaudhary<\/strong> (previously expelled from any ownership or property rights)\u2014were <strong>illegally inserted into the loan agreement<\/strong>. These individuals had <strong>no repayment capacity<\/strong>, no connection to the MSME business, and were included solely to <strong>enable a future takeover of the borrower\u2019s collateral property<\/strong> through an internal conspiracy with ICICI officers and a fraudulent advocate, <strong>Sharad Joshi<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Later, these same co-borrowers <strong>secretly filed a closure and One-Time Settlement (OTS) application<\/strong>, using <strong>fake proceedings in SA-339\/2021 before DRT Jaipur<\/strong>, without consent or knowledge of the original MSME borrower. They falsely projected that the <strong>borrower\u2019s elderly mother had voluntarily paid \u20b910,00,000<\/strong> via cheque\u2014<strong>which was forcibly retrieved from her<\/strong>\u2014to give the false impression that she intended to close the loan.
